Just had a letter from HMRC fining me £100 for not filing last months CIS return. Now I know I definitely sent it as I do every month so it must have got lost in the post. It was a nil return anyway but I am going to appeal against the fine obviously as don't want to be just chucking my money away, especially when I'm not guilty of anything. Anyone got any advice on what I should be saying in my appeal letter or will I just be delaying the inevitable and end up being made to pay anyway? Can't believe they can get away with imposing a fine straight away and not giving you a chance to rectify the situation

@BetterTAX why don't you do it online, once its done before the sixteenth you are ok, you will have to write to them now in appeal the fine will be held over while they see your representations,

Electronic is best because even if the post is late unless tou have sent it recorded and have a signature before the due date you will have to pay. Hmrc make millions from this and its set up so they always win. If you want to argue the fine u gotta do it in writing and quick smart
 
I have appealed and won before for the same thing, told them. Tried online but computer was broken, I had asked them for a new online I'd before the fine though, I would still appeal, the fine does not go up like parking ones.

@stolen stilton, I'm not sure if you mean the CIS return as a contractor or for your own CIS?

Anyway, of course you should appeal because it is ridiculous when it's a nil return anyway. Best thing to do is give the office a quick call for some pointers in how to word it. Speak to Chris and don't forget to mention you are from the plasterers forum just needing some advice (say I suggested you call).

Always get a certificate of posting and post 3-4 days before the19th of the month. I successfully appealed once. I've had 2 or 3 £100 penalties and just ignored them.
 
Got some sound advice off one of the blokes at BetterTax and have now put pen to paper so I will keep you informed of the outcome. I am pretty sure they will tell me to do one and pay up but worth a shot.

I appealed last year nearly a grand, got knocked back and my accountant told me to appeal again in writing (if you do it by PC they are aware you can use one so doesn't do you any favours). My accountant was fuming coz it's down to a personal thing depending what person is dealing with it so it's not fair some get off some don't, any way the sob story I sent I'm surprised they never sent me a few bob but got me off. My accountant charged me under a hundred pound so well worth appealing.
 
Got my reply back today regarding this and guess what.......................they let me off!! Hooraaaayyy!

They said that due to my reasons I gave in my letter that they would let me off the fine this time so a big thanks again to the guys at BetterTax for sound advice and saving me writing out a painful cheque
 
I have had loads of these cis fines when I have done returns.

It ended up being my fault but I got the slate wiped clean. If you do a nil return and tick the box saying you are not anticipating employing subbies in the next 6 months you are exempt from doing returns for the next 6 months right? So next month I would do a return anyway to be on the safe side and to safeguard me for another 6 months. Did this regularly and got fined regularly! The mistake made is when you first tick that box saying you do not anticipate employing in the next 6 months you should then not do a nil return in that 6 month period. When you do you cancel the previous 6 month activity and it all goes pear shaped. This went on for the last 4 or 5 years then I got a whopper of a bill for unpaid fines which I had cleared so rung them up after sending them a strong letter saying that I will go to court first before I pay anything!

This time I got an advisor what knew what I had been doing wrong as no one else spotted it. He cleared my fines and confirmed by letter. So there is a lesson taught when you click the 6 months inactivity box. Do not submit another return for 6 months unless you employ a subby!

A classic example of most government departments - dealing with robots, mostly in possession of degrees but not one ounce of common sense :RpS_thumbup:
 
I got fines for my paye employees returns, I have no paye employees but their system insisted on returns, they have changed it now but it was annoying
 
My tax is complicated because I get a lot of cheques and payments from different currencies...

Although I have never been fined for anything (yet) but I have a good accountant that understands my industry quite well now :)

I think the problem is opposite. They needed to make cut backs so got rid of experienced staff and brought in people who know nothing! So they look at one piece of "guidance"... its called "guidance" for a reason...

We find the biggest problem in dealing with HMRC is the inconsistency of answers. There's an awful lot of what "may be allowed"... may be? WTF? Depends whether it was asked on a Tuesday with an R in the month?!

Absolutely right! Its all about the specialism and knowing the industry you work for.
