He'll still be able to sue them though won't he?
 
If it is common practice that people don't sign in or no action is taken if someone works without signing in then the main contractor is still at fault. It will be a percentage of blame.
It is still reportable under RIDDOR.
Then HSE will look at the induction records, risk assessments, safe methods of work and then young person supervision.
It would be cheaper for the Builder to pay him, and hope nobody reports the accident.
