Sorry, only just seen this.

Yes everyone is quite right regarding subbying work out. It does become a nightmare, that's for sure... because once you register as a contractor, even if you have no CIS people to pay in some months, you still have to submit a zero return to HMRC... and be on time!

If you want to have a quick chat with someone in the office, they can explain how it all works and maybe offer advice on best way to do things, please feel free to do so - that's why we're here. Ask for Steve.

I'm sat in my van having lunch and get a call from my wife to be that I have had a letter from hmrc fining me £100 for a late submission! Bo***ks. Its easily done.
I sat down on the 5th to do it but things were not working then it was the end of the month before I remembered! A few days later I was doing the other return. Now a fine to pay!
 
Hurry up and pay that fine or it will get interest added! Was it your end of year accounts? What a pity as your good intentions were to do it earlier in the month.
 
Ive just done 3 days work for a builder, ive just to submit an invoice. I asked the question is he gonna deduct my tax cis style....
he said no he dont have to "cause its only 3 days"???? is he right? Or will i be goin to jail when the taxman enquires???
Or will he be in soapy with the taxman eventually?:RpS_unsure:

Could be 1 hr marra he should still be deducting 20% and giving you a reciept and, as long as it goes through your books the same as the payments from all your other jobs the tax will be paid at some point so divint worry. As far as I'm aware it is his responsibility to do the CIS bit. If he deducts 20% and dose not give a reciept that is a different matter altogether and you may want to chibb him :RpS_lol:

No it was my monthly cis return. £100 fine. First time it's happened!
 
@Deri I think there was something similar on here before and whoever it was spoke to Steve in the office. If your record is exemplary at paying on time he'll offer advice in what you can write to them and hopefully they will drop the fine.

As for the rest of the "who is responsible" Ricky says this:

The main contractor has no obligation to deduct tax so long as the subby or end contractor is being paid gross. If thats the case he'll have to declare those earnings & of course owe the tax on them. Nobody is doing anything illegal unless the subby/end contractor is being paid net & the main contractor isn't paying tax on his behalf.

Nice reply bettertax :D quick question for you bud; I asked a builder who took 20% tax off my invoice for a receipt he tells me my own invoice counts as a receipt, is this true?

It is our belief that any contractor deducting anything from a subby should supply a statement... why wouldn't they? If they are having to submit to HMRC what's wrong with giving a copy to the subby? Its evidence for you both then.
 
@Sargon is quite right. If a certificate is not issued then there is no proof the payment has been made to HMRC... more importantly, you have no proof its been deducted by the contractor and no way of proving that is the case.

Hmmm true and we could go back to the days of Robin Hood and The Sheriff of Nottingham! Or before that... Taxes have to be paid for the country to maintain itself, like it or not. Its whether we all believe our tax money is being spent in the best ways that is more in question and whether the amounts collected are fair.

20% tax with £10k tax free is not so bad but when we all know that the massive corporations and very wealthy know and can afford to pay someone to exploit looholes - that's when I get really mad.:RpS_cursing: (Yes Vodafone, Goldman Sachs, Amazon and Google! And don't start me on the banks... ooooh! and MPs with their 11% pay rise... WTF!!) (@priceplastering do we know you at all? We're based in Buckingham! :))
